General terms and conditions of use of the ADEL platform

Effective March 18, 2022

These General Terms and Conditions of Use (hereinafter referred to as “GTC”) govern the legal framework for the provision of the ADEL platform and define the terms of access to and use of the platform’s services by the “User.”

These GTC are available on the website https://goodalgo.fr under the “Legal Notice” section.

Any subscription to an ADEL evaluation contract implies the User’s unreserved and unconditional acceptance of these GTC. When registering on the website via the Registration Form, or when signing a certification contract, each User expressly accepts these GTC by checking the box preceding the following text: “I acknowledge that I have read and understood the GTC and I accept them.”

If the User does not accept the GTC stipulated in this contract, they must refrain from accessing the services offered by the platform.

GoodAlgo (https://goodalgo.fr) reserves the right to unilaterally modify the content of these Terms and Conditions at any time.

ARTICLE 1 : Legal Notices

The website https://adel.goodalgo.fr/adel/ is published by GoodAlgo SAS, a company with a capital of €25,500.00, registered with the Toulouse Trade and Companies Register under number B 892 004 011, and whose registered office is located at 58 Boulevard d’Arcole, 31000 Toulouse, France.

The website https://adel.goodalgo.fr/adel/ is hosted by OVHcloud, whose registered office is located in Roubaix, France.

ARTICLE 2: Access to the Platform

The platform https://adel.goodalgo.fr/adel/ allows Users access to the following services, depending on the contract purchased:

  • Ethical evaluation process for a digital and/or Artificial
  • Intelligence project.
    GDPR audit process.
  • Personalized evaluation process.
  • Free self-assessment process for a project.

The platform https://adel.goodalgo.fr/adel/ is accessible free of charge from any location to any User (client) who has previously purchased one of the evaluation contracts. All costs incurred by the User to access the platform (computer equipment, software, internet connection, etc.) are their responsibility.

Users without a current contract do not have access to the reserved services.

The Client User agrees to provide truthful and accurate information regarding their contact details and the information of the organization and project being audited.

To access the platform’s services, the User must then log in using their username and password, which will be provided after their contract is activated on the platform.

Any registered User may also request to unsubscribe by contacting GoodAlgo. This will be effective within a reasonable timeframe.

Any event due to force majeure resulting in a malfunction of the platform or server, and subject to any interruption or modification for maintenance purposes, does not engage the liability of https://adel.goodalgo.fr/adel/. In such cases, the User agrees not to hold the publisher liable for any interruption or suspension of service, even without prior notice.

The User may contact the platform by email at the publisher’s email address provided in ARTICLE 1.

ARTICLE 3: Data Collection

The platform ensures that the collection and processing of personal information is carried out in accordance with the French Data Protection Act (Law No. 78-17 of 6 January 1978).

Under the French Data Protection Act of 6 January 1978, as amended following the application in France of European Regulation No. 2016/679/EU of 27 April 2016 (applicable from 25 May 2018), by Law No. 493 of 20 June 2018 and its implementing decree No. 2018-687 of 1 August 2018, the User has the right to access, rectify, port, and erase their data, or to restrict its processing. The User may exercise this right:

ARTICLE 4: Intellectual Property

Trademarks, logos, symbols, and all platform content (text, images, sound, etc.) are protected by the French Intellectual Property Code, and more specifically by copyright law.

Users must obtain prior authorization from the platform for any reproduction, publication, or copying of the various content. They agree to use the platform’s content strictly for private purposes; any use for commercial or advertising purposes is strictly prohibited.

Any total or partial reproduction of this platform by any means whatsoever, without the express authorization of the platform operator, constitutes infringement punishable under Article L 335-2 et seq. of the French Intellectual Property Code.

In accordance with Article L122-5 of the French Intellectual Property Code, users who reproduce, copy, or publish protected content must cite the author and the source.

ARTICLE 5: Liability

The sources of information disseminated on the platform https://adel.goodalgo.fr/adel/ are considered reliable, but the platform does not guarantee that it is free from defects, errors, or omissions.

The information provided is for general informational purposes only and has no contractual value. Despite regular updates, the platform https://adel.goodalgo.fr/adel/ cannot be held liable for changes to administrative and legal provisions occurring after publication. Similarly, the platform cannot be held liable for the use and interpretation of the information contained on this platform.

The User is responsible for keeping their password secret. Any disclosure of the password, in any form whatsoever, is prohibited. The User assumes all risks associated with the use of their username and password. The platform disclaims all liability.

The platform https://adel.goodalgo.fr/adel/ cannot be held liable for any viruses that may infect the user’s computer or other IT equipment as a result of using, accessing, or downloading content from this platform.

The platform cannot be held liable in cases of force majeure or unforeseeable and insurmountable events caused by a third party.

ARTICLE 6: Hyperlinks

Hyperlinks may be present on the platform. Users are advised that clicking on these links will open other websites. Users have no control over the web pages these links lead to and cannot, under any circumstances, be held responsible for their content.

ARTICLE 7: Applicable Law and Jurisdiction

French law applies to this contract. In the event of a dispute between the parties that cannot be resolved amicably, the French courts shall have exclusive jurisdiction.
